  {"id":2446,"date":"2022-02-15T15:50:52","date_gmt":"2022-02-15T21:50:52","guid":{"rendered":"https:\/\/www.bemidjistate.edu\/services\/international\/?page_id=2446"},"modified":"2025-08-28T11:32:06","modified_gmt":"2025-08-28T16:32:06","slug":"stem-opt-extension","status":"publish","type":"page","link":"https:\/\/www.bemidjistate.edu\/services\/international\/international-students\/resources\/employment\/opt\/stem-opt-extension\/","title":{"rendered":"STEM OPT Extension"},"content":{"rendered":"<h3>OPT Extensions for STEM Students<\/h3>\n<p>The 12-month limit on F-1 OPT may be extended by 24 months, for a total of 36 months, for certain STEM degree holders (Science, Technology, Engineering, Mathematics). Students may receive the stem extension twice in a lifetime, once at the undergraduate level and once at the graduate level. Students who file for the extension may continue employment while the application is pending, up to 180 days.<\/p>\n<p><strong>Additional requirements for the 24-month extension include:<\/strong><\/p>\n<ul type=\"disc\">\n<li>Student must be currently participating in a standard period of OPT, working for a U.S. employer in a job directly related to the student\u2019s major area of study.<\/li>\n<li>Student must have successfully completed a bachelor\u2019s, master\u2019s, or doctoral degree in a field on the <a href=\"https:\/\/www.ice.gov\/doclib\/sevis\/pdf\/stemList2022.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">DHS STEM Designated Degree Program List<\/a>, from a SEVIS-certified college or university.<\/li>\n<li>Student must have a job offer or currently work for an employer that is enrolled in E-Verify and has met all of the<a href=\"https:\/\/studyinthestates.dhs.gov\/employers-stem-opt-reporting-requirements\" target=\"_blank\" rel=\"noopener noreferrer\"> STEM OPT Reporting Requirement<\/a><\/li>\n<li>Student must have less than 90 days of unemployment while on OPT<\/li>\n<li>Student must be able to submit the I-765 Form up to 90 days before the current OPT authorization expires, and within 60 days of being recommended by your DSO in SEVIS.\n<ul type=\"disc\">\n<li>The DSO must recommend the 24-month OPT extension in SEVIS, after verifying the student\u2019s eligibility, certifying that the student\u2019s degree is on the STEM Designated Degree Program List, and ensuring that the student is aware of his or her responsibilities for maintaining status while on OPT.\u00a0 The student must submit their I-765 application with USCIS within 30 days of when the I-20 recommending STEM OPT is issued.<\/li>\n<li>The employer must work with the student to complete a <a href=\"https:\/\/www.ice.gov\/sites\/default\/files\/documents\/Document\/2016\/I-983.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Training Plan Form I-983 <\/a>and agree to report the termination or departure of the student to the DSO or through \u201cany other means or process identified by DHS.\u201d An employer must consider a worker to have departed when the employer knows the student has left employment, or if the student has not reported for work for a period of 5 consecutive business days without the employer\u2019s consent.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Additional documentation needed for application<\/strong>\n<ul>\n<li>A<a href=\"https:\/\/studyinthestates.dhs.gov\/stem-opt-hub\/additional-resources\/form-i-983-overview\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a0Training Plan Form I-983<\/a> completed by both the student and employer<\/li>\n<li>A copy of the front and back of the student\u2019s current OPT card<\/li>\n<li>A copy of the student\u2019s diploma or official transcript<\/li>\n<\/ul>\n<h3><\/h3>\n<\/li>\n<li><strong>STEM students have\u00a0<a href=\"https:\/\/studyinthestates.dhs.gov\/students-stem-opt-reporting-requirements\" target=\"_blank\" rel=\"noopener\">additional reporting and evaluation requirements<\/a>.<\/strong><\/li>\n<li>\n<h3>H-1B cap-gap extension of D\/S and work authorization until October 1.<\/h3>\n<p>DHS regulations effective January 17, 2025 address this gap by automatically extending the duration of status (D\/S) and any post-completion OPT or STEM OPT work authorization of an F-1 student who is the beneficiary of a timely-filed, nonfrivolous cap-subject H-1B petition requesting a change of status and an H-1B employment start date any time in the following fiscal year. The extension lasts until April 1 of that fiscal year or until the validity start date of the approved petition,\u00a0<em>whichever is earlier<\/em>. This is commonly known as a\u00a0<strong>cap-gap extension<\/strong>.<\/p>\n<p>Notify the DSO if your employer files a Form I-129, Petition for a Nonimmigrant Worker, requesting an extension.
